Court-Martial Defense

A court-martial is a federal criminal proceeding convened by a commanding authority to adjudicate alleged misconduct by a service member. There are three types of courts-martial: General, Special, and Summary, each differing in process and potential punishment. General courts-martial address the most serious charges, while Special courts-martial typically involve misdemeanor-level offenses. Summary courts-martial are administrative in nature and are generally offered only when misconduct is acknowledged. MJA defends service members at every level of the court-martial process.

Administration Separation Defense

Administrative separation proceedings determine whether a service member will remain in the military and under what conditions they may be discharged. These boards can shape a service member’s career, benefits, and civilian opportunities. MJA represents both officers and enlisted personnel before separation boards, providing strategic advocacy focused on retention, characterization of service, and long-term consequences.

Administrative Appeals / Rebuttals

Administrative actions can derail a military career even without criminal charges. Boards for Correction of Military / Naval Records

Boards for Correction exist to remedy errors or injustices in military records. These cases often involve discharge characterizations, reenlistment codes, evaluations, awards, or other official entries. Defense Base Act (DBA)

Defense Base Act claims arise when civilian contractors supporting U.S. military operations overseas are injured or become ill while performing covered work. These federal claims can involve complex medical, employment, and insurance issues. MJA represents contractors navigating DBA and Longshore claims, helping them pursue wage replacement, medical benefits, and long-term compensation while countering insurer delay and denial tactics.

Military Mass Torts

Military mass tort cases involve widespread harm caused by governmental or contractor misconduct, often affecting large populations of service members and veterans. For more than 30 years, Marines and families stationed at MCB Camp Lejeune and MCAS New River were exposed to harmful industrial chemicals in their drinking water. Cancer and other serious illnesses have been linked to these contaminants. If you or a loved one lived or worked at Camp Lejeune or MCAS New River for at least 30 days between August 1, 1953, and December 31, 1987, and later developed a qualifying condition, you may be entitled to significant compensation. MJA represents affected Marines, veterans, and families nationwide.

Service Members Civil Relief Act (SCRA)

The Servicemembers Civil Relief Act provides federal protections for active-duty personnel against certain civil actions, including improper foreclosures, repossessions, and interest rate violations. MJA enforces these protections on behalf of service members, holding lenders and creditors accountable when they violate federal law and jeopardize financial stability or security clearances.

Military Defense Lawyers

Article 15 / Non-Judicial Punishment

Non-judicial punishment under Article 15 of the UCMJ allows commanders to address minor offenses without initiating a court-martial. Known as “Article 15,” “Captain’s Mast,” or “Office Hours,” NJP can still carry serious career consequences.

MJA advises service members on whether to accept or contest NJP and provides representation aimed at minimizing long-term impact.

Titling Actions

Titling occurs when a service member is listed as the subject of a CID investigation, resulting in indexing within federal law enforcement databases. This can occur even without charges or punishment.

Titling decisions can affect background checks, employment, and security clearances. MJA challenges improper titling and pursues corrections where evidence does not support continued indexing.
