Protecting Guardians During High-Stakes OSI Investigations

When the Office of Special Investigations becomes involved, a Guardian’s future can change rapidly. OSI inquiries often begin quietly and escalate quickly, sometimes before the member realizes they are a subject. At Peterson Space Force Base, Schriever SFB, Buckley SFB, Vandenberg SFB, Patrick SFB, and Los Angeles AFB, OSI cases frequently involve digital systems, classified access issues, interpersonal conflicts, or allegations tied to technical duties.

Military Justice Attorneys (MJA), a team of former Marine Judge Advocates, provides experienced guidance from the first moment of OSI involvement, helping Guardians avoid missteps that can permanently affect their careers.

What Is OSI Investigation Defense for Guardians?

OSI investigates alleged UCMJ offenses, security violations, fraud, digital misconduct, and other incidents affecting good order and discipline or national security. Guardians may be approached as witnesses, subjects, or suspects, and OSI does not have to reveal which role you hold.

Key investigative procedures are rooted in UCMJ standards published by the Joint Service Committee at https://jsc.defense.gov, with many Space Force investigations following Air Force protocols.

The Benefits of Working With a Military Defense Attorney for OSI Cases

  • Protection Against Harmful Statements or Waived Rights. Many Guardians speak with OSI before understanding Article 31(b) protections. We ensure your rights are preserved and prevent early statements from shaping an inaccurate narrative.
  • Analysis of Digital and Technical Evidence. OSI cases often involve system logs, digital communications, or technical procedures. We review this evidence precisely to challenge assumptions and correct investigative misunderstandings.
  • Guidance Through Command Notifications and Administrative Risks. What you say during an OSI inquiry can affect evaluations, clearances, and future qualification decisions. We help manage communication and minimize downstream consequences.
  • Coordination of Defense Strategy Across Multiple Actions. OSI investigations can lead to NJP, adverse evaluations, separation proceedings, or court-martial charges. Our representation prepares you for every potential outcome.

Is OSI Investigation Defense Relevant to My Situation?

You may need legal support if OSI has contacted you, questioned you, seized your devices, restricted your access, or interviewed your coworkers.

Guardians often become subjects after initially being treated as witnesses.

If your duties involve classified material, technical systems, secure access, or mission-critical equipment, the stakes are even higher. Immediate legal guidance helps prevent misunderstandings from escalating into administrative or criminal actions.

The OSI Investigation Process What to Expect

Step One: Understanding Your Status and Protecting Your Rights

We determine whether OSI views you as a witness, subject, or suspect and advise you on when and whether you should speak. Article 31(b) protections and investigative foundations appear in the Manual for Courts-Martial at https://www.esd.whs.mil/DD/.

Step Two: Reviewing Evidence and Identifying Risks

We analyze evidence, including statements, digital records, workplace communications, and system-access logs. Many OSI conclusions are based on incomplete or misinterpreted technical data.

Step Three: Developing a Strategic Response Plan

We guide you in avoiding harmful statements, handling OSI contact, documenting interactions, and preparing for potential administrative or punitive consequences. Accurate strategy at this stage often changes case outcomes.

Step Four: Preparing for Follow-On Actions

If OSI findings lead to NJP, adverse evaluations, separation, or court-martial charges, we coordinate a defense strategy that addresses both the initial investigation and all subsequent actions. Additional oversight resources are available through the DoD Inspector General at https://www.dodig.mil.

After an OSI Investigation What Comes Next

Even after OSI concludes its inquiry, commanders may still pursue administrative action, loss of qualifications, clearance reviews, or formal charges. Guardians may also face lingering suspicion or reduced leadership trust.

MJA assists with post-investigation representation, including NJP defense, adverse evaluation rebuttals, court-martial defense, and correction-board petitions. Our goal is to ensure the OSI process does not define your career.

"The Government Came to Bury Me, Josh Hill Buried Their Case Instead"

If you’re reading this review,...

"If you’re reading this review, there’s a fair chance you’re in trouble with the military. The answer is YES—hire Josh Hill. He is worth every penny and more. Don’t gamble with your VA benefits, your military pension, or your freedom. You only get one shot at defending your future. Trust me, this is the guy you want in your corner. When I first hired Josh Hill as my civilian military lawyer, I was staring down a mountain: 28 specifications across 6 charges in a military court-martial. The government basically made a giant mud ball, threw it at the wall, and waited to see what would stick. The stakes couldn’t have been higher—my freedom, my career, my reputation, and my benefits were all on the line. But from day one, Josh brought unmatched experience, surgical strategy, and a level of confidence that gave me hope when I needed it most. Josh Hill is a master of his craft. He navigated the UCMJ like a seasoned warrior—dissecting every allegation, exposing every weakness in the government’s case, and challenging every false assumption thrown my way. His preparation was meticulous, his presence in court was commanding, and his cross-examinations were absolutely relentless. He left no stone unturned and no argument unanswered. Because of Josh’s leadership, we went from what felt like an impossible situation to walking out of that courtroom not guilty on all charges. That wasn’t just a win—it was a total and complete vindication. And it’s 100% because of Josh Hill’s commitment, brilliance, and refusal to let the government steamroll me. Josh Hill didn’t just defend me—he saved my life. I will forever be in his debt for the sacrifices he made and the time he dedicated to my case. One last note: When he calls—ANSWER IT. Drop what you're doing, it can wait. That phone call might be the one thing that changes your future. If you want to hear my story firsthand, Josh has my permission to give you my contact info. I’ll gladly tell you exactly how he absolutely destroyed the government’s case, so I can continue with my life."

I know Mr Healy quite well. He represented me in a case where the odds were stacked against me. This was the most difficult time of my life considering some other circumstances that were added on. However, he fought for me tooth and nail even though his caseload was very high at the time. It seemed he devoted every ounce of effort to find me justice and in the end, because of his efforts, I was fully acquitted of several charges.

I will never forget that feeling for as long as I live. Upon the announcement of the verdict I nearly collapsed. My career, my life, my future was completely in his hands and he took it as seriously as I did. He is an articulate pitbull in the courtroom. I highly recommend his services if you expect to have any chance of seeing the justice you truly deserve.

Space Force OSI Investigation Defense FAQs

Do I have to speak with OSI if they contact me?

No. If OSI considers you a subject or suspect, you have the right to decline questioning under Article 31(b). Speaking prematurely can create risks that are difficult to reverse.

Can OSI search my devices or workspace?

Yes, with proper authorization. Device searches often lead to misinterpreted or incomplete data. Legal review helps ensure investigators respect search limitations and correctly interpret digital artifacts.

Will OSI notify my command immediately?

OSI often informs command early in an investigation. What you say, or do not say, before getting legal advice may influence command perceptions and evaluation outcomes.

Can OSI investigations affect my clearance?

Absolutely. Even unproven allegations may trigger clearance concerns. Early legal involvement helps maintain eligibility and prevent unwarranted adverse assumptions.

When should I contact an OSI investigation attorney?

Contact us before answering questions, consenting to searches, or discussing the case with coworkers. Early legal protection significantly improves your position throughout the investigation.
